AB 112 GOLDBERG REQUIRES ALL STRIKES TO BE SERIOUS OR VIOLENT

AB 112 (Goldberg) would submit to the voters in 2004 an amendment to the three strikes law requiring all strikes to be serious or violent felony convictions in order to subject a defendant to three strikes enhancements. It also sets up a process for inmates sentenced to life for nonviolent and nonserious felonies to petition for re-sentencing.

This bill passed the Assembly Public Safety Committee in February and is scheduled to be heard in the Assembly Appropriations committee within the next three weeks.

We are having trouble getting members of the Appropriations Committee to vote for the measure. Specifically:

Assemblymember Leland Yee (D-San Francisco) 916/319-2012
Assemblymember Ellen Corbett (D-San Leandro) 916/319-2018

The Appropriations Committee looks into the fiscal impact of bills. In the case of AB 112, reform of California's three strikes law would result in savings of billions of dollars. The savings come from reduced sentences of future inmates as well as major savings on prison construction. Additional savings from the long-term effect of Incarcerating aging and elderly inmates would be in the billions (The Sentencing Project in Washington found that at the current rate of three strikes incarceration, by 2026 Californians will be paying approximately $750 million per year just to house three strikes inmates). The bill would cost money to put the language onto a statewide initiative as well as court costs for re-sentencing hearings, but these costs to the state would still result in an offset savings.

We need everybody who can to call these two offices and ask them to support the bill. Please please please give these offices a call and tell them about the injustice of this law.

People we could save a bundle of money. Putting people in jail for life for stealing a cookie or pizza is wrong and costly to any state not only california. Education is what we need in all prisons/Jails. There are facts to show that the return rate is considerably lower when people are educated and are able to get a good job and support their families. All the money this state wastes is mind boggling. And we continue to increase the prison budget even in bad times. We could be reversing this trend if we educate.

There is a smile on my face. I just read that the warden at Ironwood stood up to the CCPOA and didn't buckle under their pressure to abandon the education program for Blythe prison inmates. Touché.

Note: I would encourage people to write to the Warden in this story to express agreement with him up. Either we give the education to all who desire it in prison (make them productive when released, remember they get a good job they will pay taxes) or we pay for it for the years these people will stay in prison. Don't you think paying 30,000 to 40,000 is worth it? Or would you perfer to pay 30,000 per year keeping these people in prison. In 10 years that would be a total of 300,000. Now you decided what is cheaper?

Jeb's proposed budget would abandon state-funded juvenile intervention programs that have kept kids -- thousands of them -- from evolving into grown-up criminals. He wants to cut $63 million from the $640 million Juvenile Justice Agency budget -- most of it from prevention programs.

Note:

I have a problem with all this religious talk about Andy. Turning to God while in prison is not uncommon. At least 90% of all inmates do so. I feel that it is a way to give them hope. Those that might get out in a few years do not follow a religious life once released. This is Hipacritical and means absolutely nothing.

A Florida court is expected to rule soon on the appeal of Lionel Tate, who was sentenced to life in prison for killing a 6-year-old playmate in 2000 when he was just 12. An adult criminal court in Florida recently convicted brothers Alex and Derek King of killing their father when one was 12 and the other 13. Meanwhile, federal and state authorities debate the most effective method of obtaining a death sentence for 17-year-old John Lee Malvo for his role in the Washington-area sniper case.

camera gif I'm curious as to why our state's attorney believes that 12 years in prison is a proper sentence for young Daniel Carter, even while admitting that Daniel may have acted in self-defense and the state may not have a decent case against him?

From all accounts of the crime, Daniel tried to avoid his uncle - he called a friend, hoping to get away from the house before his uncle came over. While being beaten by his uncle, he tried to call 911 for help, and the uncle ripped the phone out of the wall. The knife used in the "killing" was underneath Daniel's TV set, and was only available to him after his uncle violently picked up the TV and threw it to the floor.
