Daniel had just passed his 15th birthday when his uncle, Jack Carter, a Kung-fu Black belt bodybuilder, in a rage from steroids drugs and alcohol, attacked the boy in his own home while he was asleep in his room. When Daniel tried to call 911 for help the vicious attacker pulled the phone from the wall.
Daniel tried in vain to defend himself against the large 6'1 man, who refused to leave and continued to beat him with a mag flashlight and threaten to sexually mutilate him with rope in hand, a knife in his sock, a loaded gun in his truck and bullets in his pocket.
Jack broke everything in Daniel's room, including a tv, which uncovered a knife that was given to Daniel by his grandfather years earlier. During a struggle over the knife both Daniel and his uncle received multiple cut marks, only one was fatal, and while Daniel cried and called for help his uncle died in his moms arms.
But let's go back to earlier in the day to help understand what happened to unfold the events of this horrible night.
Daniel had been going through some teenage difficulties, Daniel's uncle, being the only male role model in his life, was the first person his mom, Cindy Carter, called to ask for help. She asked if he would come over and have a talk to Daniel. During the conversation she mentioned that Daniel had been looking at his uncle's surfer magazines. Jack Carter became enraged at that point and demanded to talk to Daniel. At that time he told Daniel he was going to come over and give him the beating of his life. He told him he was going to tie him up and castrate him. Cindy made Jack promise not to hurt Daniel, to only talk to him, and Jack agreed.
Daniel then proceeded to call his friend and begged to come over until things settled down, but his friend thought he was overreacting and told him no. The day wore on and Jack didn't show up, so Daniel went to bed thinking all was o.k.
Why has no bail been set? Because Daniel is being tried for first degree murder.
Why a first degree murder charge? Because earlier that day when Daniel called his friend in a desperate plea for help he made the remark that if his uncle came to mutilate him he would retaliate. But who would not make those same remarks in the same position? Would one say I will not fight back and let him attack me? The answer is no, anyone would have said the same thing.
Why the recent escape charges? When Daniel was first incarcerated he had dug a hole into the ceiling and climbed into it and laid in the fetal position. When asked about why he had done it he claimed he just wanted to go home.
